BASCA presents: Deal or No Deal – Contract Negotiation Workshop

This hands-on session focuses on contracts, negotiations and the legalities of the music industry, giving you an insight into the music business and the ability to recognise legal problems. The outputs from this all-day session will empower songwriters and composers to ask the right questions in terms of negotiating contracts.
9:30 – Registration
9:45 – Introduction to ‘Music Industry Money Go Round’ – How royalties arise and are accounted for
10:30 – Introduction to Music Contract Law – What is Copyright?
11:15 – Tea Break
11:30 – Contract Negotiations – Participants are broken into small groups of 4 or 5 each and are given a draft publishing contract in which they have about 30 minutes to read. Eric will then act as the record label/publisher to negotiate a deal with the participants. Participants are allowed to spend up to 30 minutes (all at once or in tranches) getting advice from Simon as the lawyer. There are various waypoints that have to be achieved, for example:
• Preliminary meeting with record label/publisher
• First round of negotiation
• Counter offer
• Final offer
• Label decides whether to agree deal or not
Deliberate issues/problems will be thrown into the mix that participants have to deal with.
15:30 – Eric will announce the ‘deals or no deals’ and then undertake a post-mortem to look at negotiating technique, errors of principle, rounding off with comments about the role of managers, lawyers and other professionals in the business
16:30 – Finish. Eric and Simon are happy to meet people afterwards to discuss their issues in an informal manner
